Jensen Farms Rocky Ford Cantaloupe Listeria Outbreak Lawsuits - Nationwide (2011)
In September of 2011, the Centers for Disease Control and Prevention (CDC), along with various local and state health departments, linked a Listeria outbreak to cantaloupe produced in the Rocky Ford region of Colorado. On September 14, Colorado-based Jensen Farms recalled all Rocky Ford cantaloupes sold by the company, including over 300,000 cases of cantaloupe sold between July 29 and September 10 to distributors and retailers in the following states: Colorado, Wyoming, Nebraska, Utah, Kansas, Texas, Oklahoma, New Mexico, Arizona, Illinois, Minnesota, Missouri, Tennessee, North Carolina, New Jersey, New York and Pennsylvania.
On October 18, the U.S. Food and Drug Administration released the findings of an investigation at Jensen Farms. The report detailed unsanitary conditions and improper practices at the farm’s cantaloupe packing facility.
On July 16, 2012, the CDC confirmed that at at least 147 people in 28 states had become ill with listeriosis, the illness caused by the ingestion of Listeria bacteria, after consuming Listeria-contaminated cantaloupe. At least 32 deaths and 1 miscarriage were also confirmed. Confirmed cases related to the cantaloupe Listeria outbreak were residents of the following states: Alabama (1), Arkansas (1), California (4), Colorado (40), Idaho (2), Illinois (4), Indiana (3), Iowa (1), Kansas (11), Louisiana (2), Maryland (1), Missouri (7), Montana (2), Nebraska (6), Nevada (1), New Mexico (15), New York (2), North Dakota (2), Oklahoma (12), Oregon (1), Pennsylvania (1), South Dakota (1), Texas (18), Utah (1), Virginia (1), West Virginia (1), Wisconsin (2) and Wyoming (4).
Marler Clark has filed 14 lawsuits on behalf of victims the cantaloupe Listeria outbreak.
Marler Clark is representing 44 families in this outbreak. On September 15, Marler Clark filed a lawsuit on behalf of a 71-year-old man who was hospitalized from a Listeria infection he contracted after consuming cantaloupe he purchased at Wal-Mart. On September 21, the firm filed two additional lawsuits, one in Colorado on behalf of an 84-year-old man who remains in a care facility after contracting Listeria, and the other on behalf of a Texas woman who was hospitalized after consuming contaminated Rocky Ford cantaloupe. On September 27, a lawsuit was filed in Oklahoma on behalf of the family of a man who died from Listeriosis. On September 30, another claim was filed on behalf of the family of a Maryland man who died from listeriosis.
On October 5, a claim was filed on behalf of a man hospitalized for nearly a month with a Listeria illness. On October 17, a the family of Missouri man who has been hospitalized for over a month filed a lawsuit. On October 28, a lawsuit was filed in Dallas County, Texas on behalf of the family of a woman who died after consuming contaminated cantaloupe. On November 28, the firm filed a ninth suit on behalf of the family of a New Mexican woman who died; this was the first lawsuit to contain third party food safety auditors as defendants.In late December a second Listeria lawsuit was filed on behalf of the widow of a 63-year old Albuquerque man. In February 2012, an eleventh lawsuit was filed in Colorado.
